25/05/2020 - Agree final devolution Scheme document ref: 897    Recommendations Approved

At its meeting on 21 May 2020, the Combined Authority resolved to delegate authority to the Managing Director in consultation with the Chief Executives and Leaders of the 5 West Yorkshire Councils to take any steps to finalise the scheme, and progress the public consultation exercise.

The Managing Director has made amendments to the scheme further to the consideration of and comment on the draft by the councils, and further to consultation with the Chief Executives and Leaders of each council.

Each West Yorkshire council and the Combined Authority have considered a paper w/c 18 May 2020 which set out the next stage of devolution implementation. Each paper included a draft scheme as an appendix for information and comments.

Following these meetings, and the comments received, the following changes have been made:

• Add additional wording into section 2.10 – Political Advisors for clarity -
the terms and conditions of any such appointment will be provided for by order.
• Remove the following functions from section 3.4 - Employment and Skills, as being subject to further review:
o 514A – which relates to providing boarding accommodation for people with an education health care plan
o 18A(1)(b) – which relates to provision for people who are in youth detention
o 15ZA, 15ZB & 15ZC – duty to secure enough suitable education and training is provided to meet the reasonable needs of persons over compulsory school age and under 19, and over 19 with a EHC
• Make it clear that the following function in section 3.4 - Employment and Skills will be held concurrently with Constituent Councils:
o sections 560A of the Education Act 1996 (duties and powers related to the provision of education and training for persons over compulsory school age)
The revised scheme, which includes these amendments is attached at appendix 1.

At its meeting on 21 May 2020, the Combined Authority resolved to delegate authority to the Managing Director in consultation with the Chief Executives and Leaders of the 5 West Yorkshire Councils to take any steps to finalise the scheme, and progress the public consultation exercise.

The Managing Director has made amendments to the consultation document further to the consideration of and comment on the draft by the councils, and further to consultation with the Chief Executives and Leaders of each council.

Following these meetings, and the comments received, the following changes have been made:

• The narrative has been updated following feedback to:
o Provide more information regarding the proposals and what devolution will bring to the region.
o Provide further clarity on the functions being consulted on, in line with the scheme.
o Ensure plain English is used.
• An additional section has been added to provide detail and a question relating to the finance functions.
• An ‘about you’ section has been added to enable analysis of respondents.
• A full range of ways to respond and contact details have been included.
The revised consultation documents, which includes these amendments is attached at appendix 1.

21/05/2020 - Local Cycling and Walking Infrastructure Plans ref: 786    Recommendations Approved

For the Combined Authority to adopt five phase one Local Cycling and Walking Infrastructure Plans for Bradford, Calderdale, Kirklees, Leeds and Wakefield which will propose potential future network and infrastructure improvements to help inform future investment in provision for cycling and walking.

(a)       That the Combined Authority adopt the phase one Local Cycling and Walking Infrastructure Plans (LCWIPs) produced for Bradford, Calderdale, Kirklees, Leeds and Wakefield, and that proposals included in the plans be used as inputs into the development of a transport investment pipeline.

 

(b)       That a decision on the final appearance of the phase one LCWIP documents for publication is delegated to the Combined Authority’s Managing Director, in consultation with the Chair of the Transport Committee.
