(a)    That the report be noted.

 

(b)    That the Summary of Consultation Responses be submitted to the Secretary of State by 11 September 2020, and that approval be given to jointly delegate authority to the Managing Director of the Combined Authority, in consultation with the Leader and Chief Executive of each Constituent Council and the Chair of the Combined Authority, to finalise and submit documents subject to any technical issues which may arise.

 

(c)    That the updated timetable set out in Appendix 2 to the report and the next steps which are subject to the consent being given by the Constituent Councils and Combined Authority, to the draft Order in November 2020 so that a mayoral combined authority model and associated changes may be adopted and implemented by May 2021, as set out in the Deal be noted.

 

(d)   That this decision is exempt from call-in on the grounds of urgency, for the reasons set out in paragraph 6.1 of the report.

 

(e)   That Tom Riordan, Leeds City Council Chief Executive be appointed as the Combined Authority Returning Officer (CARO) in respect of the West Yorkshire Combined Authority Mayoral election, due to take place on Thursday 6 May 2021, subject to this appointment being confirmed by the Combined Authority following the devolution Order being made in early 2021.

 

(f)    That the West Yorkshire Combined Authority becomes a full member of the Yorkshire Leaders Board, including providing a financial contribution to support regional working in line with that of the Sheffield City Region Combined Authority and larger constituent local authorities.

25/09/2020 - Corridor Improvement Programme: A646, Calderdale ref: 899    Recommendations Approved

Approval for the scheme to progress through Activity 4 (Full Business Case) and work commence on Activity 5 (Full business Case with Finalised Costs).

·       The Corridor Improvement Programme A646/A6033 Calderdale scheme proceeds through decision point 4 and work commences on activity 5 (Full business case with finalised costs).

·       An indicative approval to the total scheme value of £4.058 million is given from the West Yorkshire plus Transport Fund with full approval to spend being granted once the scheme has progressed through the assurance process to decision point 5 (Full business case with finalised costs).

·       Additional approval of £49,473 development costs from the West Yorkshire plus Transport Fund to progress the scheme to activity 5 (Full business case with finalised costs) is granted, taking the total approval to £839,054.

·       The Combined Authority enters into an addendum to the existing funding agreement with Calderdale Council for total expenditure up to £839,054 from the West Yorkshire plus Transport Fund.

25/05/2020 - Agree final devolution Scheme document ref: 897    Recommendations Approved

At its meeting on 21 May 2020, the Combined Authority resolved to delegate authority to the Managing Director in consultation with the Chief Executives and Leaders of the 5 West Yorkshire Councils to take any steps to finalise the scheme, and progress the public consultation exercise.

The Managing Director has made amendments to the scheme further to the consideration of and comment on the draft by the councils, and further to consultation with the Chief Executives and Leaders of each council.

Decision:

Each West Yorkshire council and the Combined Authority have considered a paper w/c 18 May 2020 which set out the next stage of devolution implementation. Each paper included a draft scheme as an appendix for information and comments.

Following these meetings, and the comments received, the following changes have been made:

• Add additional wording into section 2.10 – Political Advisors for clarity -
the terms and conditions of any such appointment will be provided for by order.
• Remove the following functions from section 3.4 - Employment and Skills, as being subject to further review:
o 514A – which relates to providing boarding accommodation for people with an education health care plan
o 18A(1)(b) – which relates to provision for people who are in youth detention
o 15ZA, 15ZB & 15ZC – duty to secure enough suitable education and training is provided to meet the reasonable needs of persons over compulsory school age and under 19, and over 19 with a EHC
• Make it clear that the following function in section 3.4 - Employment and Skills will be held concurrently with Constituent Councils:
o sections 560A of the Education Act 1996 (duties and powers related to the provision of education and training for persons over compulsory school age)

Each West Yorkshire council and the Combined Authority have considered a paper w/c 18 May 2020 which set out the next stage of devolution implementation. Each paper included draft consultation questions as an appendix for information and comments.

Following these meetings, and the comments received, the following changes have been made:

• The narrative has been updated following feedback to:
o Provide more information regarding the proposals and what devolution will bring to the region.
o Provide further clarity on the functions being consulted on, in line with the scheme.
o Ensure plain English is used.
• An additional section has been added to provide detail and a question relating to the finance functions.
• An ‘about you’ section has been added to enable analysis of respondents.
• A full range of ways to respond and contact details have been included.
The revised consultation documents, which includes these amendments is attached at appendix 1.

25/09/2020 - ERDF COVID-19 Recovery Grants ref: 895    Recommendations Approved

To deliver a £1.8m grants scheme across West and North Yorkshire for small businesses affected by the COVID-19 pandemic. The grants will be between £1k and £3k and the applicants will need to demonstrate how the grant will support their ongoing recovery and resilience. The funding has been awarded by the Ministry for Housing, Communities and Local Government with the condition that it is fully defrayed by the end of the financial year.

Decision:

For the Combined Authority (CA) to deliver a business grants scheme for small businesses across all of West and North Yorkshire with £1.8m of European Regional Development Funding (ERDF) awarded to the CA by the Ministry for Housing, Communities & Local Government (MHCLG) in September 2020. The grants of between £1k and £3k are to support businesses to recover from the impact of COVID-19 and, in the process, to be more be resilient to future potential business interruption. 

 

The grants scheme needs to be implemented at pace to meet the needs of businesses across the region and all funding must be fully defrayed by the end of 2020/21. Therefore, the opportunity to undertake detailed consultation has been limited. However, the CA has consulted with Local Authorities in the region and with a number of key business stakeholders, such as Chambers of Commerce, the Federation of Small Businesses and several private sector intermediaries that are members of the LEP’s Professionals’ Perspective Network.

11/09/2020 - CityConnect Phase 3 – Castleford Greenway Phase 4 ref: 894    Recommendations Approved

To enable delivery to commence on a 1.3km off-road greenway link to the Trans-Pennine Trail from the existing Wakefield to Castleford cycle routes being delivered through the CityConnect programme. This will address a missing off-road cycle link within the Methley area cycle network, and provide a complete route between Leeds, Wakefield, and Castleford.

To approve that:

• The CityConnect Phase 3: Castleford Greenway Phase 4 scheme proceeds through decision point 5 and work commences on activity 6 (Delivery).

• Approval to the Combined Authority’s contribution of £371,686.25 (which will be funded through the West Yorkshire Plus Transport Fund) is given. The total project value is £371,686.25.

• The Combined Authority enters into a funding agreement with Sustrans for expenditure up to £356,686.25 from West Yorkshire Plus Transport Fund.

11/09/2020 - Transforming Travel Centres ref: 893    Recommendations Approved

To enable development work to continue on the scheme which aims to deliver remodelled travel centres in Bradford, Huddersfield and Pontefract bus stations, bringing them in line with banks and other retailers by increasing the number of self-service machines and providing a balance of face to face counter service and self-service, thus reducing customer queueing time.

• The change request to the Transforming Travel Centre project, to increase the development costs by £51,000, bringing the total development costs to £101,000, to continue the scheme’s progression to decision point 2 of the Combined Authority’s assurance process, is approved. The scheme is funded through the LTP.
